What is a Prescribed Body Corporate?
A Prescribed Body Corporate (PBC), also known as a Registered Native Title Body Corporate (RNTBC), is a specially incorporated Aboriginal corporation established to hold and manage native title rights and interests on behalf of Traditional Owners after a native title determination has been made by the Federal Court.
The Role of a PBC
Once the Federal Court formally recognises Native Title, the Native Title Holders must establish an Aboriginal Corporation to act as their PBC.
This corporation becomes the legal entity responsible for:
Holding native title
The PBC formally holds the native title on behalf of the traditional owners, either as a trustee or as their agent, ensuring all rights are recognised.
Manage & Protect
It oversees and safeguards native title rights and interests, making sure they are maintained, respected, and exercised properly across the land.
Decision-Making
The PBC makes key decisions regarding the use of native title rights, consulting the right people and ensuring the community's voice is heard in every activity.
Representation
It acts as the official representative body for native title holders in all dealings with government, industry, and other stakeholders, advocating for their interests.
Protect Cultural Heritage
The PBC safeguards the cultural, spiritual, and historical values of the land, ensuring these are preserved for current and future generations.
Legal Framework
PBCs are incorporated under the Corporations (Aboriginal and Torres Strait Islander) Act 2006 (CATSI Act) and must comply with specific governance requirements to ensure they operate transparently and in the best interests of all native title holders.
The PBC serves as the bridge between traditional law and customs and Australian law, ensuring that the native title holders' voices are heard and their rights are protected in all matters affecting their country.
